Terms of service/利用規約

Article 1 (Member)

1. “Members” mean individuals who apply for the membership after agreeing to these terms of service in accordance with the procedure designated by National Bussan ltd Hereinafter to be the company.
2. “Membership information” means such information as the attributes of members disclosed by the members to our company and the history of transactions made by the members, and so forth.
3. These terms of service shall apply to all the members and shall be complied with by the members upon the application for the membership registration as well as after the completion of the membership registration.

Article 2 (Registration)

1. Membership qualification
Users who have applied for the membership in the manner prescribed by the company after agreeing to these terms of service are entitled to the membership after the completion of the membership registration procedure as prescribed by the company. The membership registration procedure shall be taken by a person who is to become a member. No application for the membership registration by proxy shall be allowed. The company may not accept a membership application made by a person whose membership was revoked previously or a person whom the company deems to be inappropriate.

2. Entry of membership information
When applying for the membership registration, please enter the necessary information accurately in the prescribed form after reading notes for the entry. For the registration of membership information, it is not possible to use special symbols, old Chinese characters, and Roman numbers. If these characters are registered, the company will change them.

3. Management of a password
(1) A password shall be used by a member, and it shall not be assigned or lent to any third party.
(2) A password shall be managed responsibly by the member, for example, it is recommended changing the password on a regular basis to ensure security.
(3) The manifestation of intention toward the company involving the use of a password shall be deemed to be the manifestation of intention of a member, and any payment and other obligations resulting therefrom shall be assumed by the member.

Article 3 (Changes)

1. A member shall, if there are any changes in any matters that have been informed to the company, such as name or address, notify our company of such changes without delay.
2. The company shall not assume any responsibility for damages caused by the failure of changes in the registration. Besides, please note that even if a change of the registration is made, any transaction of which formalities have been completed before the change thereof is processed based on the information that have been informed before the change.

Article 4 (Withdrawal from Membership)

When a member wishes to withdraw from membership, the member shall take a withdrawal procedure. After the completion of the prescribed withdrawal procedure, the membership will be canceled.

Article 5 (Forfeiture of Membership and Obligation for Compensation)

1. When a member makes a false declaration upon the application for the membership registration, or when a member fails to fulfill an obligation to make a payment for orders through mail order, or when there are other grounds that our company deems a member to be inappropriate as the member of this service, the company may revoke membership.

2. In case a member performs any act set forth in any one of the following items, the member shall be liable to compensate for any resulting damages that the company has incurred.
(1) To use a membership number and a password illegally.
(2) To obstruct our business by, for example, accessing our company’s home page to falsify the information therein or sending a computer program harmful to the company’s home page.
(3) To perform any act to infringe on intellectual property rights of products dealt in by the company.
(4) Or, otherwise, to perform any act against these terms of service.

Article 6 (Handling of Membership Information)

1. The company shall not, in principle, disclose membership information to a third party without obtaining members’ prior consent, provided, however, that the company may disclose membership information and other customers’ information without obtaining members’ prior consent in any one of the following cases.
(1) When disclosure is demanded by laws and regulations.
(2) When the company deems it necessary to protect the company’s rights, interests, or reputation, and so forth.
(3)”Users” is your agreement to the terms and in accordance with procedures prescribed by the company, means the person performing the application for membership and the order for shopping.

2. As far as membership information is concerned, the company manages it in accordance with our company’s “Approach to Personal Information Protection.” The company may use membership information for the purposes of providing services to the members, improving the service content, promoting the service use, and ensuring the sound and smooth operation of the services in the company.

3. The company may provide information (including ads) to the members via e-mail newsletters and other means. If a member does not wish to receive information, the company will cease to provide information after the member notifies us accordingly in the manner designated by the company. It is, however, not possible to discontinue providing information necessary for the operation of this service.

Article 7 (Prohibited Matters)

It is prohibited to perform any act that falls under the following items to members when using this service.

1. To beach laws and regulations, these terms of service, notes for the service use, notes for shopping through this service, and other terms of service.
2. To damage the rights, interests, and reputation of the company and other third parties.
3. To perform any act that may have an adverse effect on young people mentally and physically and an act against public order and morals.
4. To perform any act that causes trouble, or provides a sense of discomfort, to others.
5. To enter false information.
6. To transmit or post a harmful computer program or e-mail, and so forth.
7. To access the company’s server and other computers illegally.
8. To lend, assign, or share a password to a third party.
9. Any other act that the company deems to be inappropriate.

Article 8 (Interruption and Suspension, etc. of Service)

1. The company may, if any one of the following items occurs, discontinue providing the whole or part of this service without notice to keep the operation status of this service in good condition.
(1) When the discontinuance of this service is necessary for regular system maintenance checks and emergency maintenance.
(2) When the system is overloaded.
(3) When the system operation becomes difficult due to a fire, a blackout, or an obstructive behavior by a third party, and so forth.
(4) Or, otherwise, when the company deems it necessary to bring the system to a halt for an unavoidable reason.

Article 9 (Change and Discontinuance of Service)

The company may, at its discretion, change and discontinue the whole or part of the service without notice as needed.

Article 10 (Disclaimer)

1. The company shall not assume any responsibility for damages resulting from the disruption, delay, discontinuance of the system, the loss of data, unauthorized access to data due to the breakdown of telecommunication lines and computers, etc. and damages that the members have incurred in connection with our services.
2. The company does not warrant that anything harmful, such as a computer virus, is not included in e-mail contents delivered from our webpage server domain, and so forth.
3. The company shall not assume any responsibility for damages resulting from the breach of these terms of service, etc. by the members.

Article 11 (Amendment of Terms of Service)

1 Our company may amend these terms of service arbitrarily and may stipulate rules to supplement these terms of service (hereinafter referred to as, “supplementary rules”) following situations.
(1) When amendment of the terms of service conforms to the common interest of users.
(2) When amendment of the terms of service is reasonable that the change of contents or the recommendation of change of others.
2 Regarding to the change of the terms of service preceding paragraph, the company will inform that changing of the terms of service, the changed contents of the terms of service and the effective date by one month before on the website or email.

3 Any users using this service are deemed to have agreed to the provision of the agreement from the effective date.

Article 12 (Governing Law and Court of Jurisdiction)

If any dispute arises out of, or in connection with, these terms of service, the district court having jurisdiction over the locality of the head office of the company shall be the agreed exclusive competent court of the first instance through mutual consultation.


第1条 (会員)

1. 「会員」とは、当社が定める手続に従い本規約に同意の上、入会の申し込みを行う個人をいいます。
2. 「会員情報」とは、会員が当社に開示した会員の属性に関する情報および会員の取引に関する履歴等の情報をいいます。
3. 本規約は、全ての会員に適用され、登録手続時および登録後にお守りいただく規約です。

第3条 (変更)

1. 会員は、氏名、住所など当社に届け出た事項に変更があった場合には、速やかに当社に連絡するものとします。
2. 変更登録がなされなかったことにより生じた損害について、当社は一切責任を負いません。また、変更登録がなされた場合でも、変更登録前にすでに手続がなされた取引は、変更登録前の情報に基づいて行われますのでご注意ください。

第5条 (会員資格の喪失及び賠償義務)

1. 会員が、会員資格取得申込の際に虚偽の申告をしたとき、通信販売による代金支払債務を怠ったとき、その他当社が会員として不適当と認める事由があるときは、当社は、会員資格を取り消すことができることとします。

2. 会員が、以下の各号に定める行為をしたときは、これにより当社が被った損害を賠償する責任を負います。

第6条 (会員情報の取扱い)
1. 当社は、原則として会員情報を会員の事前の同意なく第三者に対して開示することはありません。ただし、次の各号の場合には、会員の事前の同意なく、当社は会員情報その他のお客様情報を開示できるものとします。

2. 会員情報につきましては、当社の「個人情報保護への取組み」に従い、当社が管理します。当社は、会員情報を、会員へのサービス提供、サービス内容の向上、サービスの利用促進、およびサービスの健全かつ円滑な運営の確保を図る目的のために、当社おいて利用することができるものとします。

3. 当社は、会員に対して、メールマガジンその他の方法による情報提供(広告を含みます)を行うことができるものとします。会員が情報提供を希望しない場合は、当社所定の方法に従い、その旨を通知して頂ければ、情報提供を停止します。ただし、本サービス運営に必要な情報提供につきましては、会員の希望により停止をすることはできません。

第7条 (禁止事項)


1. 法令または本規約、本サービスご利用上のご注意、本サービスでのお買い物上のご注意その他の本規約等に違反すること
2. 当社、およびその他の第三者の権利、利益、名誉等を損ねること
3. 青少年の心身に悪影響を及ぼす恐れがある行為、その他公序良俗に反する行為を行うこと
4. 他の利用者その他の第三者に迷惑となる行為や不快感を抱かせる行為を行うこと
5. 虚偽の情報を入力すること
6. 有害なコンピュータープログラム、メール等を送信または書き込むこと
7. 当社のサーバーその他のコンピューターに不正にアクセスすること
8. パスワードを第三者に貸与・譲渡すること、または第三者と共用すること
9. その他当社が不適切と判断すること

第8条 (サービスの中断・停止等)

1. 当社は、本サービスの稼動状態を良好に保つために、次の各号の一に該当する場合、予告なしに、本サービスの提供全てあるいは一部を停止することがあります。

1. 通信回線やコンピューターなどの障害によるシステムの中断・遅滞・中止・データの消失、データへの不正アクセスにより生じた損害、その他当社のサービスに関して会員に生じた損害について、当社は一切責任を負わないものとします。
2. 当社は、当社のウェブページ・サーバー・ドメインなどから送られるメール・コンテンツに、コンピューター・ウィルスなどの有害なものが含まれていないことを保証いたしません。
3. 会員が本規約等に違反したことによって生じた損害については、当社は一切責任を負いません。
